My Latest 35% Gain In One Day Winner: Why Hemispherx Biopharma Is Rubbish

TIMalert subscribers know I think the guys running HEB are scumbags–they’ve done 2 financings at massive discounts to the market price (showing no regard to their shareholders because they KNOW the shareholders are nitwits so screwed they deserve to be!) in the past few weeks by taking advantage of their pumped up stock price based on PRs detailing YEARS OLD DRUG DATA.

I shorted 300 shares at $4.18 at 10:20am on Friday, sending this alert out to TIMalert subscribers:

Shorted 300 HEB at 4.18, very small speculative position…found the shares through Thinkorswim, have 700 more reserved and I got up late so I’m guessing there are many more shares out there…I think I can make $1-2 of downside from here, but I’m keeping it small since the stock is still up on the day…biotechs are jumpy and if you read thestreet.com’s article on this carcass, you’ll see this company ain’t worth its hype

I’m still holding my miniscule position because the size doesn’t matter, it’s the great feeling of being right (already up nearly $1.50/share on my short) and my desire to rub it into those gullible/ignorant enough to believe the BS/hype….after all, this slumdog is up from 50 cents/share just one month ago!

There will always be new suckers, but I intend to create such a ruckus in the coming years (not saying these stocks aren’t good to buy, obviously the upside is nice…I want you guys to learn to buy the hype, just never believe it!) that every long-term ~~penny stock investor~~ sucker will know that Timothy Sykes warned them before they did the dumb thing that lost them so much money.

Adam F. of TheStreet.com explains what this pump and dump is all about–and contrary to the pimple-faced-snot-nosed kids and boobs posting on Yahoo Finance, the article came out at 8am, plenty of time for everyone who knows how to read to go short this pile of junk (it was reposted after my 10:20am alert, thus giving rise to the theory that Adam and I are in cohoots)…the problem obviously stemming from the fact that most people “invested” in HEB don’t know how to read…seriously…and have dreams of being invested in DNDN, VNDA, MAPP-type moves. While that very well may happen, the signs of blatant manipulation and pumping make me believe the odds are very high to be short here and I’m perfectly positioned with my ultra-small position to reap the rewards of probable further downside come Monday.

Here’s Adam’s fact-based article, facts are which the promoters and suckers are sorely lacking:

Erik D.M. writes, “Hey mister journalist, still feeling the same about Hemispherx Biopharma(HEB Quote) as you did a couple of days ago? I don’t see you writing anything negative anymore, or did you buy them yourself, too?”
Nope, I still feel the same way about Ampligen — a long shot for U.S. Food and Drug Administration approval as a treatment for chronic fatigue syndrome.

I assume Erik is taunting me because Hemispherx’s stock price is higher today than it was when I wrote my column on May 28. Well, Hemispherx’s CEO William Carter has helped his cause by hooking up with some online penny-stock promoters who’ve been flogging the stock incessantly.

The company has also fed the maws of risk-hungry retail investors by issuing a couple of hyper-promotional (but largely content-free) press releases related to Ampligen’s role to potentially treat avian and swine flu strains.

But so far, nothing from Hemispherx about the pending FDA approval decision on Ampligen. All of Carter’s bluster is designed to divert attention away from the real matter at hand, but he can only stall for so long.

And he still hasn’t answered any of the questions I posed to him in my last column.

What Carter is doing instead is taking a page from the well-worn playbook I’ve seen used countless times by companies in trouble with the FDA. In fact, Hemispherx reminds me so much of Biopure(BPUR Quote), the old human blood substitute company. That story ended badly, and so will Hemispherx.

I’ve already catalogued several inconsistencies in past statements made by the company about the clinical data coming out of Ampligen’s clinical trials. Carter’s track record hyping Ampligen is no better. Check this out:

On Hemispherx’s March 19 conference call, Carter spoke about the strong prospects for Ampligen’s approval. To back up his claim, he quoted a report from the Agency for Healthcare Research and Quality (AHRQ), a U.S. government-run organization, which stated that “Ampligen, an investigational drug that is not approved by the Food and Drug Administration, given intravenously to severely debilitated [chronic fatigue syndrome] patients yielded the most promising results.”
Ampligen is “most promising,” according to the AHRQ, an arm of the federal government. It’s a claim you hear Carter make often.

I found that AHRQ report, thanks to the Google. It was published in September 2001 — almost eight years ago. The “most promising” line about Ampligen is in the report, for sure, but it refers to the small Ampligen study done in 1993-1994, not the pivotal study of the drug conducted in 2004.

The report also states that, “In sum, evidence from trials involving immunologic therapies was relatively scant and insufficient to conclude whether these treatments were effective or ineffective.”

Not such a ringing endorsement, but then, Carter doesn’t want investors to know that, nor does he want them to know he’s quoting from an outdated report compiled eight years ago.

WOW.... the fact that you mentioned BPUR friggin scares me.. im about to short BPUR before they go completely under actually, im waiting for .20 again. I honestly suck!!! at trading, but i can honestly say, my portfolio either looses a little, or gains a little. Technically it doesnt really move. Fact is you do not have any more information about the FDA decision on this drug than anyone else that does, yet you continue to spread venom towards this company. HEB was up 133% off its lows in a few days. It was sitting almost 30% above the upper bollinger band. Stocks like that usually crash hard, especially ones that are up on hype like HEB. It's a no-brainer to short a stock like that. That's not manipulation, that's just putting the odds in your favor.

I shorted it at $4.14, covered at 3.87....then shorted again at 3.93, covered at 3.61 and 3.43, and shorted again at 2.99 and covered at 2.81.

Your conspiracy theories are utterly ridiculous. Do you believe that the government is covering up a Roswell UFO crash too? You honestly think Tim has the power to manipulate a stock trading millions of shares? Give me a break.

So now that it dropped that much, does that mean that slightly over 25% of the investments are following Tim's advice, so they all sold? Who thinks HEB will be shortable for tomorrow. BPUR is acting funny and actually seems to show potential... they have been up and down frmo .20 to .35 then .20 to .27 for the last month.. There at .26 now. Watch this stock! there also closing down soon, so it should be shortable in the near future... If you’re inclined to read any of the scientific literature behind CFS, you’ll realize that Carter’s statement (about Ampligen being the most promising treatment) is true, even if it was referring to 10-20 year old reports. Here are the *facts*:

CFS is an incredibly difficult condition to treat, and very few drugs are effective in the long-term. There are a variety of symptomatic treatments, which can help by raising blood pressure, increasing alertness, improving sleep, alleviating pain etc. Progress can always be made in finding better drugs to alleviate the symptoms (eg, newer ADHD-like medications such as provigil), but it’s still recognized that at best these drugs helps patients live with CFS rather than curing CFS, as they don’t get at any underlying causes of the symptoms, & their clinical effectiveness is limited. Treatment success in CFS is abysmal, and when it does occur relapse rate is exceptionally high.

That Ampligen – after 20-odd years – is still the most promising treatment is not a reflection of HEB being out of the times. It’s more related to the lack of successful CFS treatment research. Currently, some research is being done with a more traditional anti-viral Valcyte; some doctors are trying to treat CFS as if it were lyme disease; and sticking to their more psychological take on CFS, CDC has been pushing cognitive-behavioral therapy for CFS for at least as long as the Ampligen trials, but that has yet to really catch on. None of these approaches have proved successful, at least not yet.

In short, there simply aren’t any other drug contenders for CFS that have emerged out of the research. & that fact alone boosts Ampligen’s chances tremendously.

Tim, it's hard to put "odds" on an FDA approval. The way to play the odds on these FDA decisions is guessing what the stock price will be if it gets approved and likewise if it gets rejected, then bet the appropriate position size. In this case, i'd guess the stock will go under $1 if rejected, or over $10 if approved. Therefore if you're buying or shorting it at $4, and intending to hold until approval, it's not a great bet, as your risk/reward is about 1:1. Buying at at under $2 would be a good bet, as the risk/reward is in your favor. Shorting it somewhere close to $10 would be a good bet, also. Daytrading the momentum is fine too. It's just risky to hold overnight if your r/r is not favorable.
I agree that approval looks like a long-shot and the CEO is sketchy. But one thing that Adam F. brushes aside is that this would be the only drug specifically designed for chronic fatigue syndrome. The FDA might be inclined to approve it even with questionable efficacy so long as the safety profile is ok. If it doesn't hurt, but it might help, why not approve?

Timothy: you and that other idiot, don't know your facts. Heb has been colaborating with the Japenese for several years on the use of Ampligen as an adjuvant for the bird flu vaccine. The Japenese have completed numerous studies. It so happens that Ampligen will also provide tremendous benifits as an adjuvant for the swine flu. Ampligen has been studied for 30 years or so and has been proven safe. Most recently, on May 21, 2009 Japan's Council Awarded Innovative Technology Grants for Pandemic Influenza Vaccines Adjuvanted by Hemispherx's Ampligen(r) and that is not old news. Furthermore, the fact that Ampligen has been studied for several years by the Japenese only increases the potential of this stock, and that old news as you call it, is confirmed data, which will only help to speed up the approval Ampligen as an adjuvant. There are currently no approved Adjuvants. As far as approval of Ampligen for CFS, even if it does not get FDA approval, the potential sales as an adjuvant for flu vaccines dworfs the commerical value for CFS. And as far as using old data goes, what planet are you from? Does FDA accept 20 year old data. There has been some delays, but phase 3 trial was completed in 2005 or 2006.

Anybody interested in Heb, do some reading. Its all there on the internet. The japenese researchers name is Dr. Hideki Husegawa. Did you know that Ampligen increases the flu vaccines effectiveness by 300 to 500 percent, that it offers cross protection and that less vaccine is needed when Ampligen is added? Google "ampligen as adjuvant for flu vaccine"

I sold off some of my shares on Friday close to $3.90 because I was lucky enough to be sitting in front of my computer, when heb started to tank. I'm sure alot of people wern't so lucky and feel very badly for them that a scumbag, parasite like you, cost them their hard earned money.

So so sad, Tim is not perfect I am.. Kidding, Fact 1. I joined tim alerts and bought 2 DVDs last April, since i have gained 46%, my biggest loss to date after the fact $330 heck Ive only lost 3 times totalling $473 but gained substantially more. In an earlier post I spelled a researchers name incorrectly. correct spelling is Dr. Hideki Hasegawa. He is the primary researcher for Ampligen for the Japenese.
There are several different people with the same name. Look in zoominfo and make sure to click on 21 online sources to review study summaries. Also note, Hemispherx has been doing research on Ampligen for several years for use as an adjuvant in bird flu. This old news, as some idiots would call it, is confirmed data that will only make it easier to approve Ampligen as an adjuvant for SWINE FLU. The thinly disguised opinion piece from a writer without a science or medical degree hit it’s mark with thousands of high-strung investors who began to dump shares en-masse. Many thought Feuerstein might just be right, so they began to sell as quickly as possible. Others thought the FDA had actually rendered a negative ruling against the company because the stock was suddenly dropping in value without any other apparent explanation. Panic had hit the world of Hemispherx share holders once again.

Did Feuerstein blister the company on purpose? Was it all part of a sinister plan orchestrated to sink prices lower so someone could swoop in and salvage their piece for a lower price? Whether it was planned that way or not, at least one big investor did just that to the tune of over 230,000 shares not long after HEB parcels had bottomed at $1.51- down from a day high of $1.76.

Still, it would be expensive, time consuming and difficult to prove a conspiracy like that beyond reasonable doubt and we are not here to crucify Mr. Feuerstein for exercising his constitutionally protected rights.

The vast majority of stocks that have rapid vertical 100-200% run-ups have sharp corrections. That is a fact. There was nothing unusual about HEB's premarket pullback. In fact, it exhibited similar behavior in premarket trading on 6/3. Are you going to claim there was some conspiracy then too? Also, HEB's premarket pullback didn't begin until around 8:45 EST....nearly 45 MINUTES after Adam's article came out. So the timing of events actually don't match up with your beliefs.

Second, Tim's alert came out at 10:20 AM. However, the stock traded sideways for 10 minutes after that....indicating Tim's alert had little effect on the stock (he doesn't have enough followers to affect a stock trading millions of shares).

Third, when Adam's repost of the article came out at 10:59 AM, the stock had ALREADY tanked...indicating Adam's article had nothing to do with the rapid drop.

Thus, the rapid tank had nothing to do with Tim OR Adam. The explanation is much simpler and not sinister. HEB was up over 100% in a few days and was sitting 30% above the upper bollinger band! You honestly think a stock like that should just continue to go up? HEB's tank was nothing but panic selling by people who got scared because they had bought into a stock that was already over-extended. Combine that with stop losses getting taken out and you have a recipe for a tank.

You guys need to study a course in statistics and probability, along with the behavior of rapid run-up stocks, because you obviously have no clue about either

Tck.b keeps going and going, went from $3.50 to $19.00 in 2 months and when it has a correction as you call it, its not a 60% drop in 30 seconds, its maybe 5% in one day. I think you should take a closer look and see what actually happened, maybe you will learn something useful, something not on your stupid chart.

If you want to start talking charts, why don't you take a look at PDO, KYUS, MXC, and GBR in May of 2008. Also, why don't you check out AGEN the past few days. And while you're at it, check out LNG in November. I can give you many, many more examples.

Also, I said a 100% run-up in a FEW DAYS. You're talking about a FEW MONTHS. There's a big difference.

HEB only had a small fade from 10:20 AM to 10:30 AM. The first mini-tank didn't happen until 10:37 AM. So are you going to claim now that they waited 17 minutes? Why? All you're doing is just trying to fit the evidence to your pre-formed conclusion, rather than trying to objectively examine the evidence and draw a conclusion from it.

The big tank didn't occur until 30 minutes later. So are you going to claim that they just waited 30 minutes? Go study the behavior of most TIMAlert plays. Usually after an alert there is an immediate increase in volume and a small decrease in stock price. However, unless the stock is illiquid and only trading a few hundred thousand shares, Tim's alerts have little effect on the stock price.

Once again, the evidence doesn't favor you conspiracy theorists. But you'll keep clinging to your beliefs like religious nutcases.

The stock opened at $4.09 went up to $4.54 in before Tim sent out the alert. After that it started drifing down and when Adam put out his second story at 10:59 am, the stock tanked. This does not favor an effect of the article. In fact, HEB has shown similar premarket behavior in the past, with no articles. Also, MANY stocks that spike early premarket will fade before the open. I know this because I like to trade premarket leaders so I know their behavior. There was nothing unusual about HEB's behavior premarket.

You want to see the true effect of an article? Check out the stock behavior for stocks that Citron comes out with articles on. The effect is IMMEDIATE....there is no 30-45 minute delay. So the evidence is against you, R Moore, no matter how you look at it.

Yngvai, who cares. The fact is the stock dropped after Tim's alert. If it took 10 minutes for everyone to get their alert and act on it, what difference does it make. The stock dropped suddenly from over 4 to 3.80 shortly after Tims alert and it shook investors. They did recover their condidence somewhat, but when the second story came out, fear overtook rational and the stocked crashed. I don't why anybody did what they did, I just know the combination of the stories and the alert invoked fear and caused a massive sell off.

I used to be a TIMAlerts subscriber. The effect is immediate, and is only noticeable on illiquid stocks. HEB is not an illiquid stock. A TIMAlert isn't going to affect a stock trading millions of shares.

Second, there have been hundreds of TIMAlerts now. There's only one instance that I know of where it caused a huge rapid tank of a stock, and it was in a very illiquid stock where all the TIMAlerts subscribers were actually trying to get out (not short) as the stock fell...the stock was IDAE.

Stocks ALWAYS fall faster than they rise. Whenever you see major falls, they are usually larger and faster than major rises. This is usually do to stop losses. This is why shorting big run-ups can be so quickly profitable.

Still, there are plenty of examples of stocks that rise $1+ within minutes. Go look at CPY's intraday chart back in December. On 12/10/08, CPY had opened at $3.39 and within the first 10 minutes of trading, had risen to nearly $5. Are you going to claim this was manipulation?

No...it's called a major short squeeze. Just like HEB's tank was not manipulation...it was just the thousands of stop losses being taken out and panic selling.

Oh, and CPY is another perfect example of the chart I'm talking about. It rose over 400% in 3 days, and then quickly retraced almost 50% of those gains within 2 days. No manipulation....just typical behavior of stocks that run up so quickly.

I owned HEB long all week and made ~$1.50 a share from $1.73. Actually found out about HEBs FDA delay from Tim's thestreet.com video...so thx Tim. I actually got your Timalert in a timely enough fashion to sell if I'd wanted, but my stop was already in at $3.50ish the morning of the crash. In fact I'd just raised it that morning while in Tampa on vacation. My old lady was NOT happy with me trading on vaca, but she knew the risks with HEB. If I didn't have to go back to the lobby to get back to the internet I prolly woulda sold and then shorted along with you.

I don't like the fact that I got stop lossed out due to bad luck...Tim's alert...Adam Fuckerstein...sun spots...or Bigfoot, but you HEB longs and shorts have to realize stocks like this are going to be wild both directions in the face of all the uncertainty. Don't bitch about it...protect yourself somehow or don't invest.

FWIW I intend to buy in long Monday a.m. if it isn't too late, but with way fewer shares than I held long all week. That way if the miracle happens I get a taste of glory and if Tim/AF/Lionmaster and the rest are right and this thing is a pig wearing lispstick I'll just give back a percentage of my gains.

Part of it, is that some misinformation has been put out by F boy and Tim has endorsed him.

One of the statements was that it can't be approved because of not going through a committee, I know for a fact that's not true. So I appreciate your trading on the technicals, but when so many untruths are told in connection with shorting it more than just appears to be 'orchestrated'. If the trade is good enough on the technicals there wouldn't have to be untruths. Journalistic integrity would then demand that such mistakes be corrected but, F boy and Tim have remained silent, refusing to correct untruths.

Dr Carter did respond point by point to all issues, but I have not seen F boy or Tim respond to the counterpoints such as the committee issue, FORM 483's etc...

Mr Tim did speak highly of F boy and on thestreet.com it states

I have to say I made over 2600.00 trading this bitch buying it and would have shorted the hell out of it except for Scottrade doesnt allow shorts under 5.00. I will be opening another account real soon. This I also believe was a no brainer to short and do not think Tim could even come close to manipulating a stock like this. On the otherside I have seen some of the stocks he has posted and shorted moving less than 100,000 shares a day which potentially be influenced by his followers. Well Tim, first of all a profit isn't a profit unless it is taken. I assume the investors following you are not playing the decision because if they are they haven't made anything yet and stand to lose a great deal more than they could gain if the decision doesn't go their way.

Second of all I have to call you out, if you honestly believe that a stock like DNDN was a long shot you did not do your DD that is a fact. Their drug was rated as safe AND effective by the advisory panel. It was a miracle that they didn't get approval initially, in fact it was criminal (hence the investigation into the obvious conflict of interest). While conflict of interest standards have changed that doesn't take away from the obviously flawed decision. Frankly if you shorted DNDN at all your "biz model" sucks, that's a fact.

As far as HEB i would rather look at their chances now rather than their past failures, because honestly their past poor management doesn't have an impact on the science. If you can prove that their current filing is based entirely on 8 year old material then by all means do so, otherwise your foundation for the short you made is nonexistent. To be quite honest I highly doubt they would have made it this far if that was the case.

Both you and Adam enjoy bashing "anonymous losers" but have not responded to the counter-arguments presented by intelligent journalists like the ones at biomedreports.com but if you prefer to build straw men and cherry pick by all means, have fun!

We emphasize journalist, because according to Wikipedia the definition of a journalist is: “A person who practices journalism, the gathering and dissemination of information about current events, trends, issues, and people while striving for viewpoints that aren’t biased.”

We guess Mr. Feuerstein forgot about that last sentence in his latest articles. In his first piece he wrote: “In fact, Hemispherx reminds me so much of Biopure (BPUR), the old human blood substitute company. That story ended badly, and so will Hemispherx.” And in his second one he wrote : “… you get the picture of a company desperately trying to pump up its stock price before the FDA rejects Ampligen.”

That isn’t objective an unbiased, in fact Wikipedia also has a definition for this kind or reporting: gutter journalism.

Undoubtedly, Hemispherx could take legal action against Thestreet.com for spreading misleading information, but I would prefer them to concentrate their time and energy on moving the business forward.

The thinly disguised opinion piece from a writer without a science or medical degree hit it’s mark with thousands of high-strung investors who began to dump shares en-masse. Many thought Feuerstein might just be right, so they began to sell as quickly as possible. Others thought the FDA had actually rendered a negative ruling against the company because the stock was suddenly dropping in value without any other apparent explanation. Panic had hit the world of Hemispherx share holders once again.

Did Feuerstein blister the company on purpose? Was it all part of a sinister plan orchestrated to sink shares lower so someone could swoop in and salvage their piece for a lower price? Whether it was planned that way or not, at least one big investor did just that to the tune of over 230,000 shares not long after HEB parcels had bottomed at $1.51- down from a day high of $1.76.

Still, it would be expensive, time consuming and difficult to prove a conspiracy like that beyond reasonable doubt and we are not here to crucify Mr. Feuerstein for exercising his constitutionally protected rights.
